EGC Financial, LLC vs. Jagdish G. Prasad

Nature of Proceeding: Motion for Judgment on the Pleadings

Filed By: Miele, Kenneth J.

Plaintiff EGC Financial, LLC’s Motion for Judgment on the Pleadings is unopposed and
is granted.

Plaintiff’s request for judicial notice is granted, requesting among other things, that the
Court take judicial notice of the June 27, 2013, order deeming all of its requests for
admissions admitted.

Plaintiff has shown through judicially notice matters that Defendant Jagdish Prasad
owes $3,255.71 on a credit card debt. Defendant has not opposed the motion and
never sought to set aside the deemed admissions.

Plaintiff shall prepare a formal order for the Court’s signature pursuant to CRC Rule
3.1312 and a judgment. The Court will not sign the order provided with the moving
papers as costs and fees must be sought by way of a cost memorandum and a motion
for fees as set forth in the relevant Rules of Court.

The notice of motion does not provide notice of the Court’s tentative ruling system as
required by CRC Rule 3.1308 and Local Rule 1.06(D). Plaintiff’s counsel is ordered to
notify Defendant immediately of the tentative ruling system and to be available at the
hearing, in person, or by telephone, in the event Defendant appears without following
the procedures set forth in Local Rule 1.06(B).
