Basinov v. Ford Motor Company

Case Name: Basinov v. Ford Motor Company
Case No.: 16CV299355

Plaintiff’s Motion to Compel is GRANTED. Defendant has failed to provide responses to any of the subject requests, having simply repeated the same objections and response to each, regardless of the type or method of discovery, or form of the requests. Defendant’s responses, in particular, are wholly nonresponsive to interrogatories and requests for admission. Effectively, Defendant has failed to respond at all. Defendant’s late-filed opposition provides no satisfactory explanation for this failure to comply with the Discovery Act. Defendant must provide verified responses to each discovery request that fully comply with all of the requirements of the applicable sections of the Code of Civil Procedure – and produce all responsive documents identified in these further responses – within 30 days.

Should Defendant assert any privileges from providing responses or documents – rather than the boilerplate objections currently asserted – Defendant must provide a privilege log with sufficient information for the court and counsel to determine the applicability of any claimed privileges.

The Court finds that Defendant’s argument Plaintiff’s counsel failed to adequately meet and confer is without merit.

Monetary sanctions of $1,890 are awarded against Defendant, to be paid to Plaintiff’s counsel within 30 days. The Court finds that reasonable expenses incurred in bringing this motion are 5 hours of attorney’s fees at $360 per hour, plus the required court filing fees of $90.
