1. There is no tentative ruling for Counsel Casio Shyn’s Motion to be Relieved as Counsel.

NOTE: If a substitution of counsel has been filed on behalf of Defendant William Divine by Attorney Emmanuel Nasahlai, the Court’s tentative on the four discovery motions is as set forth below. If substitution of attorney has not been filed, the court continues this matter to October 27, 2014, 8:30 a.m., Dept. 77. Moving party to give notice, including notice to Defendant William Devine, who was not served with the four discovery motions according to the proofs of service.

2. Plaintiff Cyber Net Communications, Inc.’s Motion to Compel Responses to Form Interrogatories; Request for Sanctions is GRANTED. CCP § 2030.290. Defendant Concession International Incorporated is ordered to serve verified responses to Plaintiff’s Form Interrogatories, without objections, within 20 days. The Court finds Defendant’s failure to respond a misuse of the discovery process. CCP § 2023.010(d). Defendant Concession International Incorporated is ordered to pay sanctions to Plaintiff and its attorney in the amount of $285 within 30 days. CCP § 2023.030.

3. Plaintiff Cyber Net Communications, Inc.’s Motion to Compel Responses to Demand for Production of Documents; Request for Sanctions is GRANTED. CCP § 2031.300. Defendant Concession International Incorporated is ordered to serve verified responses to Plaintiff’s Document Demands, without objections, within 20 days. The Court finds Defendant’s failure to respond a misuse of the discovery process. CCP § 2023.010(d). Defendant Concession International Incorporated is ordered to pay sanctions to Plaintiff and its attorney in the amount of $285 within 30 days. CCP § 2023.030.

4. Plaintiff Cyber Net Communications, Inc.’s Motion to Compel Responses to Special Interrogatories; Request for Sanctions is GRANTED. CCP § 2030.290. Defendant Concession International Incorporated is ordered to serve verified responses to Plaintiff’s Special Interrogatories, without objections, within 20 days. The Court finds Defendant’s failure to respond a misuse of the discovery process. CCP § 2023.010(d). Defendant Concession International Incorporated is ordered to pay sanctions to Plaintiff and its attorney in the amount of $285 within 30 days. CCP § 2023.030.

5. Plaintiff Cyber Net Communications, Inc.’s Motion for Order Establishing Admissions; Request for Sanctions is GRANTED. The Request for Admissions are deemed admitted as of this date. CCP § 2033.280. The Court finds Defendant’s failure to respond a misuse of the discovery process. CCP § 2023.010(d). Defendant Concession International Incorporated is ordered to pay sanctions to Plaintiff and its attorney of record in the amount of $285 within 30 days. CCP §§ 2023.030 and 2033.420.
