John Nkwuo, et al. v. Farzaneh Yountchi

Case Name: John Nkwuo, et al. v. Farzaneh Yountchi, et al.
Case No.: 2014-1-CV-270322

Defendants’ Motion to Deem Matters Admitted is GRANTED. Monetary sanctions of $1,260 are awarded to Defendants, payable to counsel for Defendants within 10 days.

Plaintiff filed an untimely “Opposition” on June 22, 2016, when the last day to file and serve any Opposition was June 15, per Code of Civil Procedure §1005(b). The Court has the discretion to disregard Plaintiff’s papers, titled “Plaintiff Objection, Opposition to Defendants Motion to Compel Responses to Admission and Monetary Sanctions Against Plaintiff John Nkwuoo Inpro Per in the Amount $1,378; Memorandun of Points and Authority.” Nonetheless, the Court has reviewed the papers filed by Plaintiff – and finds them irrelevant, somewhat unintelligible, and without any substantive responses related to the subject of Defendants’ motion.

Defendants have made a sufficient showing for the orders requested in their moving papers, under Code of Civil Procedure sections 2033.280 and 2033.290.
