[TENTATIVE] ORDER GRANTING DEFENDANT’S UNOPPOSED MOTIONS TO COMPEL SUPPLEMENTAL RESPONSES

Defendant Target Corp’s Unopposed Motions to Compel are Granted. Plaintiffs, Kellly and Gil Roiz are ordered to serve verified responses to the outstanding discovery, without objections, within ten days. Defendant’s request for sanctions is granted in the reduced amount of $920. Both Plaintiffs and their Counsel, jointly and severally, are ordered to pay sanctions to Defendant, by and through counsel of record, in the amount of $920, within twenty days.

Defendant propounded supplemental form & special interrogatories and supplemental RPDs on both Plaintiffs on 2/27/14. To date, despite a meet and confer letter, Plaintiffs have not served responses. Defendant therefore seeks an order compelling both Plaintiffs to respond, without objections, to the outstanding discovery and to pay sanctions. Defendant also filed a notice of non-opposition to the instant motion on 7/23/14

Defendant’s motions are granted. Both Plaintiffs are ordered to serve verified responses to the supplemental form & special interrogatories and supplemental RPDs, without objections, within ten days. CCP §§2030.290, 2031.300.

Sanctions are mandatory. §§2030.290(c), 2031.300(c). Defendant seeks sanctions in four separate amounts of $1080 (supplemental interrogatories against Plaintiff Kelly and Counsel), $740 (supplemental document requests against Plaintiff Kelly and Counsel), $485 (supplemental interrogatories against Plaintiff Gil and Counsel) and $485 (supplemental document requests against Plaintiff Gil and Counsel). Counsel bills at $170/hour. The Court finds one hour to prepare each of these form motions to compel is sufficient to compensate Plaintiff for Counsel’s time; the Court also awards two hours for the hearing on the motion. The Court therefore awards four hours of attorney time at $170/hour, or $680 in attorneys’ fees. The Court also awards four filing fees of $60 each, for a total sanctions award of $920 against both Plaintiffs and Counsel.
