This tentative ruling is posted at 4:00 p.m. on 1/20/2015 and the matter is set for hearing on 1/26/2015 at 8:30 a.m. / If there are no parties other than Plaintiff/Petitioner, then Plaintiff/Petitioner may submit to the tentative without appearance by telephonic notification to the clerk of Dept. 46 between 8:00 a.m. and 4:30 p.m. on a date prior to the hearing or morning prior to the hearing by calling (213) 633-4902, and the court will issue the tentative ruling as the final ruling. If the other parties have appeared in the action, then the parties must first confer and all agree that the tentative ruling will be the final ruling on the matter. If the parties to the matter before the court all agree, a representative of the parties may call the clerk and submit without an appearance, and the court will issue the tentative ruling as the final ruling. If an order is required, it should be lodged directly in Dept. 46 with a copy to adverse/other parties, if any.

There are no remaining defendants in this action who have appeared in the case.

Plaintiff has failed to file a Proof of Service of Summons and First Amended Complaint [FAC] as to Defendants Plez Nobles, Myra Robertson, Walter Mason, Remedios Gregorio, Golden West Christian Church and Peter H. Heng as previously ordered.

Proofs of service as to Plez Nobles and Remedios Gregorio filed on 12/23/2014 are of no effect as they reflect service of the Complaint, not FAC.

Plaintiff is ordered to pay $250 sanctions as no proof of service as to any of the persons named in the first amended complaint were served and proof of service was not filed as ordered.

Plaintiff is ordered to file a valid proof of service as to the FAC before 02/09/2015 or Plaintiff shall pay an additional $500 in sanctions.

OSC regarding dismissal pursuant to CCP §583.150, CCP §575.2, and CCP 581(m) is set for 2/19/2015 at 8:30 a.m.
