[TENTATIVE] ORDER RE: MOTION TO BE RELIEVED AS COUNSEL

Robert Marc Hindin, attorney of record for Plaintiff Mamie Grant (“Plaintiff”), seeks to be relieved on grounds there has been an irreconcilable breakdown of the attorney-client relationship rendering the effective representation in this matter impossible. Counsel avers that his client insists on a litigation position and strategy that would be contrary to the Rules of Professional Conduct. Counsel states Plaintiff has refused to sign a substitution of attorney. (Declaration of Robert Marc Hindin, ¶ 2.) Counsel and client participated in private mediation and could not reconcile their disagreements.
Counsel’s motion complies with California Rules of Court, Rule 3.1362. Absent a showing of resulting prejudice, an attorney’s request for withdrawal should be granted. (People v. Prince (1968) 268 Cal.App.2d 398, 406.)
The Court notes that trial is currently set for February 22, 2018. Due to the close proximity of trial, counsel is ordered to appear at the hearing to discuss the status of the case.
