TENTATIVE ORDER

Plaintiff, in pro per, MACHELLE BURGESS-WILLIAMS’ motion to show that Defendant ROBERT PERRY committed fraud and perjury in securing a fee waiver from the Court is DENIED.

Defendant PERRY to give Notice.

Under Government Code section 68630 et seq. and California Rules of Court, rules 3.50 to 3.58, litigants who qualify as indigent under Government Code section 68632 and who comply with the application procedures set forth in rule 3.51 are entitled to waivers of certain court fees, and may in the discretion of the trial court be granted waivers of other court fees. (Kim v. De Maria (2013) 218 Cal.App.4th Supp. 1, 4.)

Plaintiff presents an insufficient basis to show that Defendant’s fee waivers were procured by fraud and/or perjury. Moreover, “[f]inancial information provided by [a fee waiver applicant] shall be kept confidential by the court. No person shall have access to the application except the court, authorized court personnel, and any person authorized by the applicant. No person shall reveal any information contained in the application except as authorized by law. Any hearing regarding whether to grant or deny a fee waiver request shall be held in camera, and the court shall exclude all persons except court staff, the applicant, those present with the applicant’s consent, and any witness being examined. The fact that an applicant’s fees and costs have been initially waived and the amount of the waived fees and costs are not confidential.” (emphasis added.) (Gov. Code, § 68633(f).)

Plaintiff’s motion is denied.
