Matthew Stirtz vs. John L. Sullivan Investments, Inc.
Nature of Proceeding: Motion for Order Approving Settlement of Claims
Filed By: Katofsky, Alex P.
Plaintiff’s motion for approval of class action settlement of this representative action brought under the Private Attorney General Act (“PAGA”) is UNOPPOSED and is GRANTED, as follows.
The notice of motion does not comply with Code of Civil Procedure §1010 or CRC Rule 3.1110(a).
Moving counsel failed to comply with CRC Rule 3.1113(d)-(e).
In this representative action under PAGA, plaintiff alleges defendant employer violated various wage-and-hour provisions of the Labor Code. The parties have agreed to settle this action for a total payment of $385,000 with plaintiff’s attorneys to receive fees in the amount of $134,750 (35% of the total payment) plus costs of $6,336.91. The plaintiff representing the aggrieved employees will receive a service payment of $7,500 with the claims administration fees of ILYM Group, Inc. not to exceed $7,500. The balance of the settlement ($228,913) will be allocated 75% ($171,684) to the Labor and Workforce Development Agency and 25% ($57,228) to the roughly 300 aggrieved employees during the relevant period from May 2016 to January 2018.
The court finds that this settlement is fair, reasonable and adequate.
Finding no objection thereto, the court will sign the proposed order submitted with the moving papers.
