Judgment Debtor shall file and serve not later than Friday, April 13, 2017 a Declaration with attached exhibits reflecting who owns and resides in the real property sought to be exempt as a homestead, and the amount sought to be exempt from attachment under CCP 704.740, 704.720, as he has declared that he and his spouse live separate and apart. He shall further clarify how he can pay $2,500 in mortgage, or any of his living expenses, if he has zero income and his spouse earns $2,500.

The ruling does not affect the Judgment Creditor’s right to apply to the court for an order of examination. CCP § 708.110, et. seq.

Any opposition may be filed and served by Wed., April 25, 2018.
