Plaintiff propounded form interrogatories and RPDs on Defendant, Hamza Rougui 1/06/17. To date, despite multiple attempts to meet and confer, Defendant has not served responses. Plaintiff therefore seeks an order compelling Defendant to respond, without objections, to the outstanding discovery and to pay sanctions.

Plaintiff’s motions are granted. Defendant is ordered to serve verified responses to form interrogatories and RPDs, without objections, within ten days. CCP §§2030.290(a),(b), 2031.300(a),(b).

Sanctions are mandatory. §§2030.290(c), 2031.300(c). Plaintiff seeks sanctions in the amount of $2060/motion. Specifically, Plaintiff seeks to recover two hours of attorney time to prepare each motion and two hours of attorney time to appear at the hearing, all at $500/hour, plus filing fees of $60 each. The Court awards one hour of attorney time to prepare each of these form discovery motions, and reduces the hourly billing rate to a more reasonable $300/hour. The Court awards the requested two hours to appear at the hearing, but only awards the time once. The Court therefore awards a total of four hours of attorney time at the rate of $300/hour, or $1200 in attorneys’ fees. The Court awards two filing fees of $60 each, or $120 in court costs.

Sanctions are sought and imposed against Defendant only and not against his attorney of record; he is ordered to pay sanctions to Plaintiff, by and through counsel of record, in the total amount of $1320, within twenty days.
