Background Facts
Plaintiffs, Lisa Reggio and Carly Marie Harm filed this action against Defendants, Sovereign Health os Los Angeles Culvery City, et al. for damages arising out of medical malpractice and related claims.
Plaintiffs filed this action on 6/19/17. On 11/29/17, Plaintiff filed proof of service of the summons and complaint on Defendant, Dan Aronow, M.D. The POS indicates Defendant was served via personal service at 9808 Venice Blvd. in Culver City.
Motion to Quash
At this time, specially appearing Defendant Aronow moves to quash service of the summons and complaint, contending he was not at 9808 Venice Blvd. on the date and time when he was purportedly served. He also declares that the description of the person who was purportedly served does not match a description of him.
Once a defendant files a motion to quash, the burden immediately shifts to the plaintiff to establish that service of the summons and complaint was proper. Summers v. McClanahan (2006) 140 Cal.App.4th 403, 413. Any opposition to this motion to quash was due on or before 3/08/18. The Court has not received any opposition to the motion. In light of the lack of opposition, the motion to quash is granted.
