I. Background

Plaintiff has filed a verified First Amended Complaint (“FAC”) for quiet title. Plaintiff claims to own the real property at 1929 W. 146th St., #1, Gardena, CA 90249 – APN 4062-007-054. The property was acquired by Lorne, Virgil, and Rose Littlejohn by grant deed on December 30, 1999. Virgil and Rose quitclaimed their interests to Lorne via quitclaim deed on December 4, 2003. Plaintiff, Lamont Littlejohn, is not listed on the title.

A notice of delinquent assessment lien was record on April 18, 2017, the default was not cured and the property was foreclosed on by Gardena Villas West Owners Association aka Gardena Villas HOA. At the foreclosure sale, defendant Liberty Fund won the bidding at $127,800 on October 5, 2017.

The Court sustained Liberty Fund’s demurrer without leave to amend on September 18, 2018.

Before that ruling, Liberty Fund filed this motion for terminating sanctions.

According to the Minute Orders of October 2, 2018, and October 5, 2018, Liberty Fund was to submit a new proposed judgment. The next hearing is set for October 26, 2018.

This motion is taken off calendar as moot.
