Defendants’ Motion to Compel Verifications and further responses to certain discovery requests is granted.
Plaintiff shall provide further responses to each item set forth in the Separate Statement. The objections raised in the responses and amended responses are overruled. However any document contended to be privileged may be set forth in a privilege log served with the further responses.
Plaintiff, in opposition, states that further responses and verifications have been provided after the motion was filed. The motion to compel may be heard even if tardy responses are served after the motion is filed. Unless the propounding party takes the motion off calendar, the court may determine whether the responses are legally sufficient and award sanctions for failure to respond on time. Sinaiko Healthcare Consulting, Inc. v Pacific Healthcare Consultants (2007) 148 Cal.App.4th 390, 404. In addition, plaintiff states that some objections have still been asserted. Since the Court is granting the motion to compel further responses without objections, this motion is not moot and defendant is entitled to a court order compelling the further responses.
Plaintiff is ordered to serve further verified responses, without objections, to the following discovery:
(1) Form Interrogatories, General: Nos. 6.4, 6.5, and 12.4.
(2) Form Interrogatories Limited Civil: Nos 115.1, 115.2, and 115.3.
(3) Special Interrogatories: Nos. 1, 2, 4, and 5
(4) Requests for Production: No. 3
The further responses and verifications shall be served no later than December 20, 2018.
The minute order is effective immediately. No formal order pursuant to CRC Rule 3.1312 or further notice is required.
