Plaintiff Eusebia Santiago’s (“Plainitff”) motion for issuance of preliminary injunction is UNOPPOSED and is GRANTED as follows.
On November 1, 2018, Plaintiff sought and obtained a Temporary Restraining Order (“TRO”) and an Order to Show Cause re: preliminary injunction (“OSC”) prohibiting defendants from proceeding with the foreclosure sale of Plaintiff’s home.
The Court finds that none of the named defendants have filed any response to the OSC, which is construed as a concession of the merits of Plaintiff’s application and the grounds for issuance of the requested preliminary injunction. Accordingly, this Court finds that Plaintiff has carried her burden of production here and is, therefore, entitled to a preliminary injunction against the foreclosure of Plaintiff’s home.
In light of the foregoing, a preliminary injunction prohibiting the foreclosure sale of Plaintiff’s property is granted.
Plaintiff shall post no later than December 3, 2018 an injunction bond in the amount of $10,000. In the event Plaintiff fails to timely post the injunction bond, defendants may file and serve an appropriate motion or application to modify, amend or vacate the preliminary injunction granted herein.
The TRO issued on November 1, 2018, is dissolved and the OSC issued on the same date is discharged.
This minute order is effective immediately. No formal order pursuant to CRC Rule 3.1312 or further notice is required.
