MOTION FOR PROTECTIVE ORDER AND SANCTIONS PURAUANT TO CODE OF CIVIL PROCEDURE SECTION 2034.250, 2023.010 AND 2023.030 BY MELANIE HILDEBRAND, NIEL HILDEBRAND, AND HILDEBRAND N&M 2002 TRUST AKA NIEL F. JR. & MELANIE M. HILDEBRAND 2002 TRUST (SUED AS DOE 1) TENTATIVE RULING:

The Motions of Defendants Melanie Hildebrand and Niel Hildebrand, Jr. (“Defendants”) for a Protective Order and Sanctions are DENIED.

Motions concerning expert discovery must be heard or before the 10th day before the date initially set for trial of the action. (See C.C.P. § 2024.030.) This case was set for trial on November 14, 2018, but continued to February 11, 2019 because there were no trial departments available. (See November 14, 2018 Order.) Pursuant to the court’s order, discovery remains closed. (Id.) Therefore, this discovery motion is untimely.

This denial is without prejudice to any motion in limine brought before the trial judge.

Defendants’ Request for Judicial Notice is GRANTED.

If the tentative ruling is uncontested, it shall become the order of the Court, pursuant to Rule 3.1308(a)(1), adopted by Local Rule 3.10, effective immediately, and no formal order pursuant to Rule 3.1312 or any other notice is required as the tentative ruling affords sufficient notice to the parties.
