CROSS-DEFENDANTS GUO MIN LI, MINGCHA KUANG, LIZI HU, ANTHAN WEICHAUN HE, AND HUA BIN HE’S MOTION TO EXPUNGE LIS PENDENS AND FOR ATTORNEY’S FEES AND COSTS TENTATIVE RULING:

Cross-defendant Buyers’ motion to expunge lis pendens is granted. The Cross-complaint fails to state any cause of action that would constitute a real property claim under Code of Civil Procedure section 405.4. Further, since this Court has already granted summary judgment against all cross-claims against Cross-defendant Buyers, the claims do not have any probable validity.” (Code of Civ. Proc. Sect. 405.3.)

As the prevailing moving party, Cross-defendant Buyers’ request for attorney’s fees is granted in the amount of $5,572.00.

The lis pendens filed by 1893 Woodland EPA, LLC is expunged.

Cross-complainant 1893 Woodland EPA, LLC, shall pay to Cross-defendants Guo Min Li, Mingcha Kuang, Lizi Hu, Anthan Weichaun He, and Hua Bin He the single sum of $5,572.00 in attorney’s fees.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Cross-defendants shall prepare a written order consistent with the Court’s ruling for the Court’s signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
