[TENTATIVE] order RE:

defendant’S motions to Compel Responses to Discovery

On September 24, 2018, Defendant Rafik Karapetyan (“Defendant”) filed the instant motions to compel responses to written discovery. Defendant also requests sanctions.

Defendant has filed a motion to compel responses from Plaintiff Alex Aguilar (“Plaintiff”) for: (1) Form Interrogatories (“FROG”), set one; (2) Special Interrogatories (“SROG”), set one; and (3) Request for Production of Documents (“RPD”). Plaintiff has failed to oppose.

On June 22, 2018, Defendant served the discovery requests on Plaintiff. As of the filing of the motions, Defendant states that Defendant has not received responses from Plaintiff.

CONCLUSION AND ORDER

Defendant’s motions to compel responses to the FROG, SROG, and RPD, are granted pursuant to CCP §§2030.290 and 2031.300. Plaintiff Alex L. Aguilar is ordered to provide verified responses to Defendant’s form interrogatories, special interrogatories, and request for production and inspection of documents, without objections, within thirty (30) days of notice of this order.

Defendant requests sanctions against Plaintiff. The Court finds Plaintiff’s failure to respond a misuse of the discovery process. Sanctions have been sufficiently noticed against Plaintiff and Plaintiff’s counsel, Michael V. Jehdian. The Court grants sanctions for 3 hours to prepare the motions and appear at the hearing, at $200 per hour, plus three $60 filing fees, for a total of $780. Plaintiff Alex L. Aguilar and Plaintiff’s counsel Michael V. Jehdian, Esq., jointly and severally, are ordered to pay monetary sanctions in the amount of $780 to Defendant, by and through counsel, within thirty (30) days of notice of this order.

The moving party is ordered to provide notice of this order and file proof of service of such.
