[TENTATIVE] ORDER GRANTING DEFENDANTS’ UNOPPOSED MOTIONS TO COMPEL

Defendants propounded supplemental interrogatories and supplemental RPDs on Plaintiff on 8/24/18. To date, despite two attempts to meet and confer, Plaintiff has not served responses. Defendants therefore seek an order compelling Plaintiff to respond, without objections, to the outstanding discovery and to pay sanctions.

Defendants’ motions are granted. Plaintiff is ordered to serve verified responses to supplemental interrogatories and supplemental RPDs, without objections, within ten days. CCP §§2030.290(a),(b), 2031.300(a),(b).

Sanctions are mandatory. §§2030.290(c), 2031.300(c). Defendants seek sanctions in the amount of $1180/motion. Defense Counsel bills at the rate of $160/hour. Counsel declares he spent three hours preparing each set of moving papers, including a separate statement. These are not motions to compel further responses, and no separate statement was necessary or filed. The Court awards one hour per motion to prepare these form discovery motions. No opposition was filed and therefore no reply was necessary. The Court awards the requested three hours to appear at the hearing, but only awards the time once. The Court therefore awards a total of five hours of attorney time at the requested rate of $160/hour, for a total of $800 in attorneys’ fees. The Court also awards two filing fees of $60 each, for a total of $120 in costs.

Sanctions are sought and imposed against Plaintiff and her attorney of record, jointly and severally; they are ordered to pay sanctions to Defendants, by and through their attorneys of record, in the amount of $920, within twenty days. Defendants are ordered to give notice.
