Defendant Rena Singh’s motion for a terminating sanction due to Plaintiff Susanne Renkvist’s failure to comply with an order compelling her to respond to written discovery is DENIED without prejudice.
Because Singh did not attach the discovery requests to the motion, the court cannot determine whether Renkvist’s failure to comply warrants a terminating sanction, as opposed to an evidence, issue or other sanction in the first instance.
Singh’s alternative request for a monetary sanction, however, is GRANTED.
Pursuant to CCP ยงยง 2023.010(g) and 2023.030(a), the court imposes a monetary sanction against Renkvist in the amount of $555 (3 hrs @ reasonable rate of $185/hr). Renkvist shall pay the sanction no later than February 1, 2019. If Renkvist fails to pay the sanction by such date, then Singh may lodge for the court’s signature a formal order awarding sanctions, which may be enforced as a separate judgment. (See Newland v. Superior Court (1995) 40 Cal.App.4th 608, 615.)
The court expresses no opinion about the sufficiency of any discovery responses served after the motion was filed.
The minute order is effective immediately. No formal order pursuant to CRC 3.1312 or further notice is required.
