[TENTATIVE] order RE:

defendant’s motions to compel discovery responses

Defendant Emile’s Mobil, LLC (“Defendant”) moves to compel responses from Plaintiff Maria Gomez (“Plaintiff”) to form interrogatories, special interrogatories, and requests for production. Defendant served the discovery on Plaintiff by mail on August 3, 2018. Therefore, Plaintiff’s responses were due by September 7, 2018. Plaintiff has filed no opposition to this motion, and it does not appear that Plaintiff has served responses to the interrogatories or requests for production. Therefore, the motion is granted.

Defendant requests sanctions against Plaintiff’s counsel. The Court finds Plaintiff’s failure to respond a misuse of the discovery process. The Court grants sanctions in the amount of $980, based on four hours to prepare the motions and appear at the hearing at a rate of $215 per hour, as well as filing fees in the amount of $60 each.

CONCLUSION AND ORDER

Defendant’s motions to compel responses are granted per Code of Civil Procedure sections 2030.290 and 2031.300. Plaintiff is ordered to serve verified responses to Defendant’s special interrogatories, form interrogatories, and requests for production of documents, without objections, within 20 days of notice of this order.

Plaintiff’s counsel Joseph S. Nourmand is ordered to pay monetary sanctions in the amount of $920 to Defendant, by and through counsel, within 20 days of notice of this order. Defendant is ordered to provide notice of this order and file proof of service of such.
