Motion by Defendant, Massoud Gafouri, to Compel Plaintiff, Carin Memmer’s, Deposition and for Costs Including Reasonable Attorney’s Fees, filed on 12/14/18 is GRANTED. Cal. Code Civil Procedure § 2025.450. Plaintiff, Carin Memmer, is ordered to appear and testify at deposition within twenty (20) days on a date duly noticed by Defendant.

A party can move to compel another’s deposition where the deponent fails to proceed with it. Cal. Code Civil Procedure § 2025.450.

Plaintiff’s counsel has not responded to Defendant’s requests to meet and confer with respect to Plaintiff’s requests for accommodations. Motion, Ex. F. The issue regarding specialty made glasses appears moot since Defendant offered to stipulate not to require Plaintiff to read or review documents during the deposition. Declaration of Eve Korff, ¶ 14.

The Court imposes sanctions of $690.00 against Plaintiff, Carin Memmer, and her counsel, Stephano Formica, Esq. Plaintiff has not shown substantial justification for failing to proceed with the deposition or otherwise respond to Defendant’s efforts to meet and confer regarding Plaintiff’s requests for accommodation. Cal. Code Civil Procedure §2025.450(g)(1).
