[TENTATIVE] ORDER RE: MOTION TO BE RELIEVED AS COUNSEL

Craig L. Chisvin, attorney of record for Plaintiff, seeks to be relieved as counsel on grounds there has been a breakdown of the attorney-client relationship. Absent a showing of resulting prejudice, an attorney’s request for withdrawal should be granted. (People v. Prince (1968) 268 Cal.App.2d 398, 406.) However, this Motion, declaration, and proposed order must be served on the client and all other parties who have appeared in the case. (Cal. Rules of Court, Rule 3.1362(d).) There is no proof of service showing this motion and supporting papers were served on Plaintiff and Defendants. Accordingly, this Motion to be relieved is DENIED without prejudice.
