Tentative Ruling: The court denies defendant Gregory B. Stanislawski’s motions for orders compelling plaintiff to provide further responses to special interrogatories and request for production of documents.
On February 21, 2019, defendant propounded requests for production of documents and special interrogatories on plaintiff. Responses were due on March 28. On that date, plaintiff served responses consisting solely of objections. On April 18, plaintiff’s counsel stated an intent to give full responses so no motion would be necessary. No responses had been received and, on June 5, defendant’s counsel sent a meet and confer letter to which there was no response. On July 3, defendant filed motions to compel further responses.
Plaintiff’s counsel states that, on July 14, he served full responses to the interrogatories. On July 15, he sent to defendant’s counsel documents that were referenced in the responses to the interrogatories and that were responsive to many of the document requests. On July 23, plaintiff’s counsel served a full response to the document request, though he still needs to transmit further documents to defendant’s counsel.
The motions are moot as there are now supplemental responses. Therefore, the court denies defendant Gregory B. Stanislawski’s motions for orders compelling plaintiff to provide further responses to special interrogatories and request for production of documents.
