Motion for Terminating Sanctions, to Compel Compliance, and for Monetary Sanctions

Defendant Harrison Chow seeks an order dismissing with prejudice the complaint of Plaintiff Jesus Sandoval because of Plaintiff’s failure to comply with the court’s November 14, 2014 order compelling Plaintiff to serve within 20 days verified responses without objection to form interrogatories, special interrogatories, and request for production of documents. The motion is unopposed. The motion is granted. The complaint is dismissed with prejudice as against Defendant Harrison Chow.

The November 14, 2014 order also required that Plaintiff pay monetary sanctions to Defendant in the amount of $734. Defendant now also requests that the court make an order compelling payment of the sanctions. As the court has already made an order requiring Plaintiff to pay the sanctions, a further order requiring the same action is not necessary or appropriate. That relief is therefore denied.

Finally, Defendant requests monetary sanctions in the amount of reasonable fees and costs incurred in making this motion. Plaintiff is ordered to pay to counsel for Defendant Chow within twenty days of notice of this order an additional sum of $734, so that the total amount of sanctions owing is now $1,468.
