The Motion of counsel, JEFFREY L. MOLCHAN, TO BE RELIEVED AS COUNSEL is GRANTED.

Department 93 will not be in session for the 1:30 PM law and motion calendar on February 13, 2015. Please use Court Call to notify the judicial assistant in Department 93, at 1:30 PM on February 13, 2015, whether you are submitting on the tentative ruling or wish to be heard. If either party would like to be heard, the judicial assistant will provide you with the date on which you may be heard.

BACKGROUND

This case arises out of an incident on July 1, 2012, during which June De Young (“Plaintiff”) alleges she was injured due to the failure of the air conditioning unit in her apartment. Plaintiff alleges she sustained freon poisoning and skin burns. Plaintiff filed a complaint on June 20, 2014, asserting a cause of action for General Negligence against Warner Center Summit LTD (“Defendant”), the owner of the apartment building. Plaintiff hired Jeffrey L. Molchan (“Counsel”), of the Legal Offices of David Grey, to represent her in the case against Defendant. This motion to be relieved as counsel was served by mail on all parties on December 3, 2014 and filed on December 8, 2014. No opposition has been filed.

DISCUSSION

Counsel asserts irreconcilable differences have arisen between him and Plaintiff which prevents Counsel from effectively representing her. Additionally, Counsel has submitted Civil Forms MC-051, MC-052, and MC-053. Counsel has also filed proof of service of the same on Plaintiff and Defendant. Furthermore, trial is not scheduled until December 21, 2015, and therefore granting this motion will not prejudice Plaintiff. Accordingly, this motion is GRANTED.

JEFFREY L. MOLCHAN is ordered to give notice of this ruling.
