Ruling: For the reasons set out below, the matter is continued to 4/14/20 at 10:30 am with all TROs to remain in force and effect until the hearing on the matter.
Analysis:
Mother filed a Petition for Dissolution on 1/8/20 after a 3-month marriage; one child DOB 11/2019; filed a 17-page request for a DVRO [DV-100] on 1/8; includes a request for Father to return car seat base and stroller for minor child. Father to return iPhone to mother [does not appear in the TRO]. The declaration as to past abuse in support of TROs is very disturbing if found to be true at a hearing.
Judge Maxwell signed a TRO on 1/9/20 that includes personal conduct orders, stay-away orders, move-out order; debt payment order [father must pay landlord $1,150/mo], record conversations orders, and child custody and visitation orders, i.e., sole physical and legal custody to mother, and no visitation unless it is supervised, to father pending the hearing.
Mr. Morales filed a Status Report on 1/17 and requested that the DVRO request, and all temporary DV orders, be continued four weeks from March 12th to attempt service again.
POS. The Court found no timely proof of service filed. The matter will need to be continued.
