MOTION TO SEAL COURT RECORDS

TENTATIVE RULING:

The motion is denied without prejudice. The supporting evidence consists solely of the Declaration of Cory Narog. The declaration sets forth no facts showing that any portion of the file in this matter has resulted in adverse treatment of or harm to Plaintiff or any other person. The declaration’s statement that third persons referred to Plaintiff’s “history” and “past” does not support a finding that the papers filed in this lawsuit are the matters to which those third persons were referring.

Defendant has requested that the court take judicial notice of various other civil and criminal actions in which Plaintiff has been involved. (See Defendant’s Request for Judicial Notice in Opposition to Petition for Restraining Order, filed November 29, 2010). The request for judicial notice is granted. Given Plaintiff’s involvement in six other legal actions, the Court cannot conclude that the present case is the “history” or “past” that is purportedly affecting Plaintiff.
