MOTION TO COMPEL PLAINTIFF TO PROVIDE FULL AND COMPLETE RESPONSES TO DISCOVERY AND FOR SANCTIONS BY SHANNON K. LANCE TENTATIVE RULING:

The motion is GRANTED. Plaintiff John Paul McMonagle shall provide verified responses, without objection, to the form interrogatories, special interrogatories and requests for production of documents within 14 days.

The Request for Sanctions is DENIED for failure to provide facts supporting the amount requested. CCP §2023.040. The declaration of Shelley Kramer does not provide any details as to how the amount was incurred. There are no facts as to the total time spent preparing the motion nor the reasonable hourly rate for the individuals involved.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Defendant shall prepare a written order consistent with the Court’s ruling for the Court’s signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
