Defendant HV-Houston Development, Inc.’s (“HV-HD”) motion pursuant to Code of Civil Procedure §391.4 to dismiss plaintiff in pro per’ complaint in this action for the latter’s failure to timely furnish security in the amount of $25,000 is UNOPPOSED and is GRANTED as follows.
This court on 10/25/2018 determined that plaintiff is a vexatious litigant who has no reasonable likelihood of prevailing on the claims asserted in the present action and therefore, required plaintiff to furnish security in the amount of $25,000 no later than 11/30/2018.
Defendant HV-HD now seeks dismissal of the entire action because plaintiff has failed to furnish the requisite security of $25,000. Since the court finds that plaintiff has failed to furnish security as previously ordered and has also failed to (timely) file any opposition, the present motion is granted pursuant to Code of Civil Procedure §391.4.
Pursuant to CRC Rule 3.1312, moving defendant to prepare a judgment of dismissal of the entire action.
