The Probate Court hearing to approve the settlement in the above-referenced matter was continued from February 1, 2018 to April 2, 2018. Attached is a true copy of the Notice of the Continuance given to Plaintiffs by their Probate Attorneys. Plaintiffs respectfully request that your honor continue the OSC re Dismissal Hearing to a date 60 days after the Probate Court hearing of April 2, 2018 as opposed to dismissing the case. Regards. Therefore, the court finds good cause not to dismiss the matter at this time and continues the OSC re dismissal after settlement to 4/23/2018 at 8:30 a.m. in Dept. 46.

If there is no showing of good cause, on 4/23/2018, the court, pursuant to CRC 3.1385, will dismiss the action. The dismissal shall be without prejudice conditional upon the court retaining jurisdiction to enforce the terms of the settlement pursuant to CCP §664.6.
