Plaintiff Bedrosian’s motion for an order striking corporate defendant 13 Games LLC’s answer is GRANTED. 13 Games LLC is a corporate defendant and may only appear through an attorney.
Bedrosian’s further motion for an order striking Defendant Patricia Hunnington’s answer because she failed to sign it is also GRANTED. The answer is only signed by fellow pro per defendant Joshua Merrill. If Hunnington wishes to proceed in pro per, i.e., without a lawyer, then she must personally sign the answer. (See CCP § 128.7 (a).)
The court grants 13 Games LLC and Hunnington until 12/10/18 to file and serve a valid answer(s). These defendants’ defaults shall not be sought or entered until 12/14/18, and only if an answer(s) have not been filed beforehand.
Plaintiff’s request for a monetary sanction pursuant to CCP § 128.7 is DENIED.
The minute order is effective immediately. No formal order pursuant to CRC 3.1312 is required.
The notice of motion does not provide notice of the court’s tentative ruling system, as required by Local Rule 1.06(D). Counsel for moving party is directed to contact opposing parties forthwith and advise of Local Rule 1.06 and the court’s tentative ruling procedure. If counsel for moving party is unable to contact opposing parties prior to hearing, counsel for moving party shall be available at the hearing, in person or by telephone, in the event an opposing party appears without following the procedures set forth in Local Rule 1.06(B).
Plaintiff shall serve notice of this ruling forthwith.
