[TENTATIVE] ORDER RE: MOTION TO COMPEL

On March 8, 2018, Plaintiff Lewis Newman (“Plaintiff”) filed a complaint for premises liability against Defendant Beginner’s Mind Zen Center (“Defendant”), arising out of an alleged incident that occurred on November 29, 2016. Defendant served Plaintiff with Special Interrogatories (Set One) via mail on January 4, 2019. Plaintiff failed to respond to the request despite multiple extensions, meet and confer efforts, and a representation that verified responses, without objections, would be served on June 10, 2019. (Declaration of Ward ¶¶3-10, 14-15; Exhibits A-B.) There is no opposition.

Based on the foregoing, Defendant’s motion to compel is GRANTED. Plaintiff is ordered to serve verified responses, without objections, to Special Interrogatories (Set One) within 20 days of the date of this order.

The request for monetary sanctions is GRANTED and imposed against Plaintiff and Plaintiff’s counsel, jointly and severally, in the reduced amount of $440.00 to be paid within twenty (20) days of the date of this order.
