The court is inclined to grant petitioner Sabino Rodriguez’s Petition to Approve Compromise of the Pending Action on behalf of minor claimant Marco Rodriguez.
Pursuant to California Rules of Court, Rule 7.952(a), petitioner and minor claimant is required to attend the hearing on the petition but the court finds good cause to dispense with the appearance of minor based on his medical condition.
BACKGROUND
On June 23, 2016, plaintiff Marco Rodriguez, a minor, by and through his guardian ad litem, Sabino Rodriguez, filed a complaint against defendants Quang Thanh Le, M.D. (“Dr. Le”) and Community Hospital of Huntington Park for medical negligence.
On June 9, 2017, the court granted defendant Dr. Le’s application for determination of good faith settlement.
DISCUSSION
The court has reviewed the petition and finds the settlement amount to be fair and reasonable. Petitioner has attached copies of the doctor’s reports, Medi-Cal lien letter, and a copy of the retainer agreement. Counsel’s declaration is sufficient to support the attorney’s fees requested. Notice is proper. The probate department has reviewed the proposed special needs trust, and the court makes the requisite findings pursuant to Probate Code §3604.
The court is therefore inclined to grant the petition.
Petitioner is ordered to give notice of this ruling.
