[TENTATIVE] ORDER RE: MOTION TO BE RELIEVED AS COUNSEL

Maya L. Serkova, attorney of record for Defendant Roman Vakhramov (“Defendant’), seeks to be relieved as counsel on grounds Defendant has failed to assist in the representation. Counsel avers Defendant does not take her phone calls and responds to email or text messages after significant delay, which has impacted the representation overall. (Declaration of Maya L. Serkova, ¶ 6.) Absent a showing of resulting prejudice, an attorney’s request for withdrawal should be granted. (People v. Prince (1968) 268 Cal.App.2d 398, 406.)

The Court notes that trial is currently set for May 2, 2018. However, on November 17, 2017, Defendant applied for a determination of good faith settlement. Defendant Liongate Global has opposed the good faith settlement, and the hearing is set for February 23, 2018. Due to the proximity of this contested hearing on Defendant’s application for determination of good faith settlement, Counsel is required to appear at the hearing on this Motion to be Relieved to discuss the status of this case.

Further, Counsel failed to provide a Proposed Order (MC-053) in compliance with California Rules of Court, Rule 3.1362. Counsel is ordered to bring the proposed order to the hearing.
