This matter is continued on the court’s own motion to April 20, 2018 at 02:00 p.m. in this department.

Counsel have not met and conferred in person or by telephone as required under CCP § 439(a). Counsel shall promptly meet and confer pursuant to statutory requirements.

Counsel is reminded that the meet-and-confer requirements of Code of Civil Procedure §439 are not optional and they are required to participate in the meet-and-confer efforts “in person or by telephone.”

If counsel determine at the conclusion of their discussions that the Court need not rule on some or all the motion, then counsel for moving party shall promptly notify the Court of the same in writing and, if appropriate, ask that the motion be dropped from calendar.

If counsel determine the motion is meritorious, then counsel for moving party shall

promptly notify the Court of the same in writing. If appropriate, counsel for moving party shall lodge a stipulation and order granting opposing party leave to file an amended pleading. Where a challenged complaint cannot be cured through amendment, an appropriate request for voluntary dismissal should be be filed.

If further efforts at an informal resolution of the motion are totally unavailing, then counsel for moving party shall file a supplemental declaration to that effect.

Whatever the outcome of counsels’ further discussions, counsel for moving party shall notify the court of the outcome no later than April 13, 2018.
