Defendant Patricia Heustess’s motion for an order compelling responses to her first set of form interrogatories is UNOPPOSED and GRANTED.
Huestess served the discovery on 10/20/17, but Plaintiff Pamela Palmieri did not serve any responses.
No later than 1/22/18, Palmieri shall serve verified written responses, without objections, to the first set of form interrogatories.
Because the motion is unopposed, no monetary sanctions are imposed in connection with the order compelling responses to the first set of form interrogatories.
Heustess’s further motion to have her first set of requests for admissions deemed admitted is UNOPPOSED and GRANTED.
Pursuant to CCP ยง 2033.280(c), the court imposes a mandatory monetary sanction in the amount of $160 (.5 hrs @ reasonable rate of $200/hr + $60 filing fee). Palmieri shall pay the sanction no later than 2/08/18. If Palmieri fails to pay the sanction by such date, then Heustess may lodge for the court’s signature a formal order awarding sanctions, which may be enforced as a separate judgment. (See Newland v. Superior Court (1995) 40 Cal.App.4th 608, 615.)
