MOTION FOR ORDER IMPOSING TERMINATING SANCTIONS
TENTATIVE RULING:
Plaintiff ROIC CALIFORNIA, LLC’s Motion for Terminating Sanctions is DENIED. Plaintiff’s request for monetary sanctions in the amount of $1,225.00 is likewise DENIED. It is entirely within the Court’s sound discretion to determine which sanction to impose on a disobedient party or, indeed, whether sanctions should be imposed at all. Code Civ. Proc. §§ 2030.290, 2030.300 (Court may make those orders that are just if a party fails to obey prior orders). Given the circumstances, the terminating and/or monetary sanctions requested in the instant motion are inappropriate.
Defendants’ request to extend the deadline for their verified discovery responses is GRANTED. The Court previously entered an Order requiring Defendants to serve verified responses, without objections, to Form Interrogatories – General (Set One) and Request for Production of Documents (Set One) no later than February 2, 2018. (Order filed January 29, 2018.) Defendants were also required to pay monetary sanctions in the amount of $1,150.00 no later than February 2, 2018. Id.
The February 2, 2018 deadline for verified responses and payment of previously issued sanctions is extended to March 16, 2018.
