Plaintiff Techno-Advanced Inc. filed this action against Defendants Legendary Builders Corp. and Grovewood Properties LLC, arising out of the alleged failure to pay for equipment, material, and labor for a construction project in West Hollywood. Legendary Builders filed a cross-complaint against Grovewood and Michael Dubelko, who is alleged to be the president or managing member of Grovewood.

Grovewood moves for an order compelling Legendary Builders to respond to its request for production, set two, and special interrogatories, set two. In its opposition, Legendary Builders has shown that it served supplemental responses to the discovery on 1/3/2018, after the motion was filed. The motion is therefore moot. While the court has authority to award sanctions, they are denied in light of the confusion as to whether a separate statement should have been filed with the motion.
