MATTHEW TAYLOR, et al. vs. SOBRIETY AND ADDICTION SOLUTIONS, LLC, et al. ; BC661310, FEBRUARY 20, 2018
[Tentative] Order RE: PLAINTIFFS’ REQUEST FOR DEFAULT JUDGMENT AGAINST DEFENDANTS SOBRIETY AND ADDICTION SOLUTIONS, LLC AND MYLIFE RECOVERY CENTERS, INC.
Plaintiffs Matthew Taylor and Mr. Assurance, LLC (jointly, “Plaintiffs”) request that the Court enter default judgment against Defendants Sobriety and Addiction Solutions, LLC and MyLife Recovery Centers, Inc.
The Court notes the following deficiencies with Plaintiffs’ default judgment packet:
· Plaintiffs have not submitted a percipient witness declaration pursuant to California Rules of Court, rule 3.1800(a)(2). Declaration by counsel is insufficient, as counsel is not a percipient witness to the events that gave rise to this action.
· Plaintiffs have not submitted a declaration regarding interest computations pursuant to California Rules of Court, rule 3.1800(a)(3).
The Court orders that Plaintiffs correct the above deficiencies and resubmit the default judgment packet.
The OSC re Default Judgment is continued to March 13, 2018, at 8:30 AM. Plaintiff need only file the above declarations by March 8, 2018.
DATED: February 20, 2018
