Specially appearing defendants Second District Appellate Court, et al.’s motion pursuant to Code of Civil Procedure §391.4 to dismiss plaintiff in pro per Charles Reginald Cooks’ complaint in this action for the latter’s failure to timely furnish security in the amount of $5,000 is UNOPPOSED and is GRANTED as follows.
This court on 11/15/2017 determined that plaintiff is a vexatious litigant who has no reasonable likelihood of prevailing on the claims asserted in the present action and therefore, required plaintiff to furnish security in the amount of $5,000 no later than 12/29/2017.
Defendants now seek dismissal of this action because plaintiff has failed to furnish the requisite security of $5,000. Since the court finds that plaintiff has failed to furnish security as previously ordered, the present motion is granted.
Having received no objection thereto, the court will sign the proposed order submitted with the moving papers.
