Defendant’s amended petition to compel arbitration of plaintiff’s claims in this matter pursuant to a written arbitration agreement is UNOPPOSED and is GRANTED for the reasons stated in the moving papers. The Court construes plaintiff’s failure to (timely) file any opposition as a concession of the merits of defendant’s motion, which is therefore granted.

Defendant is awarded attorney fees in the amount of $1,400, representing four hours of attorney time, plus costs of $285 for defendant’s first appearance fee and the $60 motion fee for this petition to compel arbitration.

The arbitrator shall be appointed pursuant to the provisions set forth in Code of Civil Procedure §1281.6.

This action shall be stayed pending completion of the arbitration proceedings.
