Defendants’ motion to seal is UNOPPOSED and is GRANTED.

Defendants move to seal the following documents which were filed on 2/6/2018: (1) opposition to summary judgment, (2) separate statement, (3) index of exhibits, and (4) Declaration of Michael Sapoznikow.

Defendants move to seal the documents because they include Plaintiff’s confidential tax records and references thereto. The Court finds that the tax records pertaining to Plaintiff warrant sealing under CRC Rule 2.550 et seq. Good cause to seal exists since the tax records contain personal, private and sensitive information which warrants protection from public disclosure, the right of public access to this information does not outweigh defendant’s interest in protecting the information, the value of the information being shielded will likely be prejudiced if disclosure is not limited, the proposed limit on access is narrowly tailored to only the private and sensitive information contained in the tax records and there are no less restrictive means to protect the value of the private and sensitive information.

As a result, the motion to seal is granted. Appropriately redacted versions of the documents have been filed and the unredacted versions were lodged conditionally under seal.

The Clerk is directed to file and seal the opposition to summary judgment, separate statement, and Declaration of Michael Sapoznikow conditionally lodged with the motion so that they are unavailable for public viewing.

The Court notes that the unredacted index of exhibits conditionally lodged with the motion are permanently bound. The Court cannot file and seal permanently bound documents. Thus, Defendants are directed to submit an unbound version of the index of exhibits directly to the Clerk in Department 54. The Clerk shall then file and seal the index of exhibits, making them unavailable for public viewing.
