Plaintiff’s motion to compel Defendant Rancho Murieta Country Club’s further responses to request for admissions (set four), form interrogatories (set four), and request for production of documents (sets six and seven) is ruled upon as follows.

Request for Admissions No. 18

The motion is DENIED. Defendant objected that the request is vague and ambiguous, and calls for the premature disclosure of expert witness information. It then stated “without waiving said objections, deny.” Plaintiff appears to have brought the instant motion to challenge Defendant’s objection. However,
Defendant has provided a complete response to the request at issue. Defendant has denied the request. This response is sufficient. Accordingly, the Court need not rule on Defendant’s objection.

Form Interrogatories

The motion is GRANTED. The Court is aware that Defendant served unverified amended responses to the Form Interrogatories after the motion was filed.

Defendant shall serve a verification by no later than March 7, 2018. Defendant need not re-serve the discovery responses. The Court makes no determination regarding the sufficiency of Defendant’s responses.

Request for Production

The motion to compel further responses is GRANTED. At issue are two requests for production. As to RFP No. 36, Defendant responded “the documents are equally available to plaintiff.” As to RFP No. 38, Defendant raised a number of objections, without providing a response. After the motion was filed, Defendant appears to have served some documents in response to the requests for production. However, Defendant’s actual responses do not comply with CCP 2031.210 et seq. Defendants are required to provide a code compliant response.

Defendant shall serve further written responses to the Request for Production by no later than March 7, 2018.
