· GRANTED. This unopposed Motion to Consolidate actions Tejada v. Mendz, CIV 534120 with Chjolankeril v. Zednem Properties 16 CIV 01448 is Granted. The lead case shall be Tejada v. Mendez, CIV 534120, and all future filings shall be under a consolidated case caption in that lead case.

· The Court finds that the cases arise out of the substantially same facts and legal issues, and there is no apparent prejudice that would result from consolidation.

· In Tejada Plaintiff home improvement contractor seeks to collect unpaid monies for construction done on the same home that is the subject property in both cases. The original owners Mendez & Zednem raised construction defects as a defense for non-payment.

· In the other case Chjolankeril, the subsequent owners also sue Tejada the home improvement contractor for allegedly defective work, and name the first owners Mendez & Zednem as additional defendants.
