TENTATIVE RULING:

The Motion of Defendant/Cross-Complainant Lynn Ho Tu (“Cross-Complainant”) to Compel Further Responses to Demand for Inspection of Documents from Cross-Defendant Musich Crystal Springs L.P., is CONTINUED to 9:00 a.m. on March 28, 2018 in the Law and Motion Department.

Cross-Defendant contends that this motion is moot because it has notified Cross-Complainant that any and all claims by Cross-Defendant are now waived, and thus Cross-Defendant should be dismissed. Accordingly, Cross-Complainant and Cross-Defendant are to meet and confer by telephone regarding whether or not this motion is moot. If this motion is not moot, the parties are to file status updates with the court by March 21, 2018 advising what issues, if any, remain. If no status updates are filed, then the court will be inclined to drop the motion as moot.

If the tentative ruling is uncontested, it shall become the order of the Court, pursuant to Rule 3.1308(a)(1), adopted by Local Rule 3.10, effective immediately, and no formal order pursuant to Rule 3.1312 or any other notice is required as the tentative ruling affords sufficient notice to the parties.

The Motion of Defendant/Cross-Complainant Lynn Ho Tu (“Cross-Complainant”) to Compel Further Responses to Demand for Inspection of Documents from Cross-Defendant Liberty Mutual Insurance (“Cross-Defendant”), is CONTINUED to 9:00 a.m. on March 28, 2018 in the Law and Motion Department.

Cross-Defendant contends that this motion is moot because it has notified Cross-Complainant that any and all claims by Cross-Defendant are now waived, and thus Cross-Defendant should be dismissed.
