The petition for change of name and gender pursuant to Health & Safety Code §103435 is GRANTED. The petitioner filed an affidavit of a physician documenting the gender change.

However, because the petitioner was not born in this state, the Court does not have jurisdiction to order that a new birth certificate reflecting the new gender be issued. (Health & Safety Code §§103425, 103430(c).)

The Court will sign the decree submitted with the moving papers but will strike Paragraph 5, which provides for issuance of a new birth certificate.

Pursuant to Health & Safety Code §103435, a certified copy of the Court’s decree shall within 30 days be filed with the Secretary of State.
