REQUEST FOR ORDER ATTORNEY FEES AND COSTS, MOTION TO COMPEL

TENTATIVE RULING

Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the court makes the following findings and orders:

Respondent mailed Petitioner a Request for Produce on 08/28/2017. Petitioner’s answers and documents were not timely served under Code of Civil Procedure § 2031.300(a) and hence her objections to Respondent’s demands were waived. Additionally, the responses that Petitioner provided for Request No. 1, No. 2, No. 3, and No. 5 were incomplete. Therefore, the Court should grants Respondent’s motion to compel and orders the following: (1) within ten business days, Petitioner shall produce cancelled checks for the Wells Fargo accounts from January 1, 2013 to present; (2) within ten business days, Petitioner shall produce credit card statements from January 1, 2015 through November 2015; and (3) within ten business days, Petitioner shall produce unredacted tenant agreements tied to the 74 Douglass Street residence from 2015-2017.

The Court grants Respondent’s request for sanctions of $2,860, as Petitioner failed to fully comply and timely respond to Respondent’s Request for Production, and his meet and confer demand.

Petitioner’s request for attorneys’ fees is denied.
