Ruling: The Temporary Protective Order issued on 1/10/18 shall be maintained in place until April 24, 2018, at 9:30 a.m. to give the parties the opportunity to document their settlement. The CMC set for 4/3/18 is continued to 4/24/18 at 8:30 am.
Analysis: The Court has not signed the Writ because the last word that the Court has is that: “The parties are currently working out the details of their settlement agreement.” (See the CMCS filed recently by Plaintiff on 3/19/18 for the CMC set for 4/3/18.)
It appears that signing the requested Writ might be premature; the Court has read the stipulation of March 3 that provides “ . . . the Temporary Protective Order issued on January 10, 2018, that currently is in place, will continue to remain in place and be effective until the new hearing date of March 27, 2018. WHEREAS, the Temporary Protective Order, issued on January 10, 2018, will be expanded to include not only those property items expressly itemized and included in the Court’s written order, but also encompass (1) the Pascucci Goleta, Inc. bank account number 705012830 at American Riviera Bank; and also (2) the proceeds, if any, which may otherwise become available to Defendants from the liquor license no. 563128 held by Pascucci Goleta, – Inc. as Primary Owner.”
The Court could find no update on the matter in the computer and it appears that the better approach is simply to continue the Temporary Protective Order issued on 1/10/18 until April 24, 2018, at 9:30 a.m. to give the parties the opportunity to document their settlement. The CMC set for 3/4/18 should be continued also.
