Plaintiff Consolidated Electrical Distributors, Inc.’s unopposed motion to deem matters admitted is granted, unless Defendant Dennis Eugene Luikens serves, “before the hearing on the motion,” proposed responses that are in substantial compliance with CCP § 2033.220. (CCP § 2033.280(c).)

Plaintiff’s request for monetary sanctions is granted. (CCP § 2033.280(c).) Defendant Dennis Eugene Luikens shall pay to Plaintiff a mandatory monetary sanction in the amount of $350 ($350/hr x 1 hr). The monetary sanction is to be paid on or before April 27, 2018. If the sanction is not paid by that date, Plaintiff may prepare for the Court’s signature a formal order granting the sanction, which may be enforced by a separate judgment. (Newland v. Superior Court (1995) 40 Cal.App.4th 608, 615.)

The notice of motion does not provide notice of the court’s tentative ruling system, as required by Local Rule 1.06(D). Counsel for Plaintiff is directed to contact Defendant

forthwith and advise Defendant of Local Rule 1.06 and the court’s tentative ruling procedure. If counsel for Plaintiff is unable to contact Defendant prior to hearing, counsel for Plaintiff shall be available at the hearing, in person or by telephone, in the event Defendant appears without following the procedures set forth in Local Rule 1.06
